Gunshot-Induced Fear Counts For Asylum, 9th Circ. Says

Law360, New York (August 31, 2016, 3:15 PM ET) — The Ninth Circuit reversed a Board of Immigration Appeals denial of asylum to a Salvadoran who was shot by guerrillas then fled his country to avoid being killed, saying Tuesday that the board wrongly found he did not show he was individually targeted.

The BIA had concluded that Jose Mendez was credible and had “articulated a social group which is visible within Salvadoran society as affiliation with the army during the civil war period,” according to Tuesday’s opinion. But the evidence did not sufficiently back up…
