H-1B Worker’s Suit Against Firms Is Old News, Judge Says

Law360, New York (September 14, 2016, 10:45 PM EDT) — A Pennsylvania federal magistrate recommended Tuesday that a suit brought by an H-1B worker against two law firms be thrown out, saying the worker’s claims were barred by a legal principle known as “res judicata,” as well as a release agreement he had signed.

U.S. Magistrate Judge Susan Schwab recommended that a federal judge dismiss a suit from plaintiff Sandeep Nayak against McNees Wallace & Nurick LLC and CGA Law Firm, saying the suit reasserts the “same nucleus of claims” raised by Nayak in separate matters….
