A Federal Judge ruled that parts of President Obama’s “executive action” are unconstitutional. The decision was issued yesterday and it said that the President’s action went beyond “prosecutorial discretion” since it gives strict guidelines for adjudication of applications. He -added that these guidelines obviate any meaningful review on case-by-case basis.
Jonathan Adler of the Washington Post comments that the judge did not even have to reach the constitutional issue to rule on the case. The case was an illegal reentry case for someone who entered after being removed.
You should not worry, however, there is a small chance that this ruling will affect you personally. The decision applies in the District Court and will surely be appealed.
