The EB-5 Immigrant Investor Program allows foreign investors to obtain a green card and a path to citizenship by investing at least $1 million in a new commercial enterprise that creates at least 10 full-time jobs for qualifying U.S. workers.

Eligibility Criteria for U.S. Citizenship as an Investor

The investor must meet certain requirements to qualify for citizenship through the EB-5 program, including:

  • Investment amount: This could range from $500,000 if the investment is in a designated TEA to $1 million if the investment is standard in a new commercial enterprise.
  • New Commercial Enterprise: The investment must be made in a new commercial enterprise, which is a business established after November 29, 1990, or an existing business that has been restructured or expanded to meet the program’s requirements.
  • Job Creation: The investment must create at least 10 full-time jobs for U.S. workers within two years of the investor’s adjustment of status or entry into the U.S. on an EB-5 visa.
  • At-Risk Investment: The investment must be at risk to generate a return on capital. 
  • Active Involvement: The investor must be involved in the day-to-day management or policy formation of the enterprise. 
  • Source of Funds: The investor must prove that the funds used for the investment were obtained legally, providing documentation such as bank statements or tax returns.

Once an EB-5 application is approved, investors and their immediate family members receive a conditional green card valid for two years.

Pathway to U.S. Citizenship by Investment

To transition from conditional to permanent residency, investors must file Form I-829 within 90 days before the green card's two-year anniversary, proving that the investment has fulfilled all program requirements, including job creation and maintaining the at-risk investment.

After successfully removing conditions, they receive permanent residency without conditions. Following five years of holding a green card, they may apply for U.S. citizenship through naturalization, meeting additional requirements such as physical presence in the U.S., continuous residence, good moral character, proficiency in English, and passing a civics test.
